On Monday, the White House said businesses can proceed with the President’s vaccine and testing requirements for private businesses. This is despite the order by the federal appeals court that vaccine testing and rules should be temporarily halted.

The Republican attorneys general in Texas, Louisiana, Mississippi, South Carolina, and Utah, as well as several companies, requested the pause. They argued that the requirements exceed the authority of the Occupational Safety and Health Administration, which will enforce the mandates, and amount to an unconstitutional delegation of power to the executive branch by Congress.
The requirements for businesses with 100 or more employees include ensuring all staff has received the shots required for full vaccination latest by January 4th, 2022, after which unvaccinated workers will be required to submit a weekly negative Covid-19 test to gain access to the workplace.
From December 5, 2021, all unvaccinated workers must start wearing face masks indoors at their workplaces.
At least 26 Republican attorneys general in different states have challenged the President’s vaccine and testing requirements in five different U.S. Appeal Courts. In addition, the Republican National Committee has said it has also challenged the requirements in the D.C Court of Appeal.
The ruling from the 5th U.S. Circuit Court of Appeals comes after numerous Republican-led states filed legal challenges against the new rule, which is set to take effect on Jan 4.
“We think we people should not wait,” said White House deputy press secretary Karine Jean-Pierre, when asked what employers should do. “It is important and critical to do, and waiting to get more people vaccinated will lead to more outbreaks and sickness.”
An average of about 1,100 Americans are dying daily from COVID-19, most of them unvaccinated. COVID-19 has killed over 757,000 people in the United States.
“We’re trying to get past this pandemic and we know the way to do that is to get people vaccinated, so people should not wait,” Jean-Pierre said.
